Court records: Teacher accused of sexually abusing student since May

An English as a Second Language teacher at Dobie Middle School was arrested Nov. 17 and charged with sexually abusing a student since May, court documents show.

Pedro Esteban Rosas Martinez, 30, is accused of placing his hand on the inner thigh of a 12-year-old student and touching her vagina, according to an arrest affidavit filed after Rosas Martinez’s arrest. A cellphone video the student brought to Austin school district police Oct. 31 shows a man who appears to be at a desk and work station moving his hand “between the victim’s knee and vaginal area,” the affidavit said.

That same day, police spoke to Rosas Martinez, who was wearing the same clothing as the man in the video, the affidavit said. The student told police Rosas Martinez “did attempt to gain entry through the top of her pants, but he was unsuccessful,” the document said.

The teacher was placed on administrative leave with pay Oct. 31, according to a letter to parents from Principal Jesse De La Huerta. He has been recommended for termination from the Northeast Austin school.

The student was later interviewed and reported that Rosas Martinez had assaulted her on a continual basis since the beginning of May, when she was in the sixth grade, the affidavit said.

The document said the child resumed taking classes with him during her seventh-grade year, and the behavior by Rosas Martinez continued.

The student said that three different times while the teacher touched her, she saw Rosas Martinez become aroused, the affidavit said.
