Former West Lake Hills official indicted on misconduct charges

A former West Lake Hills city planner has been indicted by a Travis County grand jury on charges of abuse of official capacity, a third-degree felony.

Davin Fillpot showed a conflict of interest by operating a for-profit business while working part-time for the city, according to a recently unsealed indictment. The document alleges that six times from June 2013 to August 2014, Fillpot used his city position and email address to benefit three clients at his architecture firm.

Fillpot was taken into custody Monday and released on a personal recognizance bond. He is scheduled to appear in court Nov. 18. If convicted, Fillpot could face up to 10 years in prison.

Fillpot made anywhere from $20,000 to $100,000 in the deals, according to the indictment, which also noted that Fillpot was in violation of the city of West Lake Hills code of ethics.

He left his position with the city at the end of 2013 to start his own architecture firm. However, he agreed to stay on during the transition and work a handful of hours a week. He continued to use his city email address during that time.

In June 2014, the American-Statesman reported that Austin-based architect Jeff Needles emailed Fillpot in January, seeking public information for a client who was interested in buying property at 806 Redbud Trail to build a single house on. Fillpot responded that he would be in touch. However, that same day, Fillpot met with a private client, Keller Capital CEO Mitch Johnson, to chat about 806 Redbud Trail.

Johnson hired Fillpot as a consultant for a planned subdivision at the site, and Keller Capital bought 806 Redbud Trail.

Later that month, the Public Integrity Unit, an office within the Travis County district attorney’s office, informed West Lake Hills officials that they had received a complaint about a possible conflict of interest involving Fillpot. The unit announced it was launching an investigation.
